i saw carey grant say that in a movie. thanks for watching. megyn is next. remember the spin stops here. we are definitely looking out for you. breaking tonight, after weeks of attacks from republicans and democrats, and angry questions from the media and his supporters, president obama just rewrote his fundamental health care promise to america. wait until you hear the latest version. welcome to "the kelly file," everyone. i'm megyn kelly. after mounting criticism over broken pledges and failed promises, president obama stood before a room full of supporters in washington, d.c. just a short time ago this evening. instead of taking responsibility for his clearly broken promises, he decided to rewrite his oft

repeated guarantee that if you like your health care plan you can keep it, period. listen. if you had one of these plans before the affordable care act came into law and you liked that plan what we have said is you could keep it. if it hasn't changed since the laws passed. >> no. that's not what you said. that's not true. that's not what he said. again, there has been no attempt to acknowledge earlier promises and the fact they weren't true. the only question remaining is whether the original promises were lies or mere misstatements. we told you last week this administration knew as far back as 2010, perhaps earlier that millions of americans could not keep their plans under obama care. we showed you the document. they knew. today a wall street journal report suggests the white house

in particular also knew at the time the president made the promise that the promise was not true. it wouldn't hold for millions of people. the journal wrotes sources saying those objections internally by some of the policy folks were over ruled by the political folks. so the president continued on with this promise again and again and again. >> you've got health insurance, you like your doctor, you like your plan, you can keep your doctor, you can keep your plan. >> you like your doctor or health care provider, you can keep them. if you like your doctor, you will be able to keep your doctor, period. if you like your health care plan, you will be able to keep your health care plan, period. no one will take it away. no matter what. if you like your health care plan, you can keep that, too. if you like your doctor, you keep your doctor. if you like your current insurance, you keep that insurance, period.

end of story. >> mark thiessen is a former speech writer for president george w. bush. you are uh the man to talk to. you have intricate knowledge into how presidential speeches and comments are crafted and vetted. the journal reports today, quote, some white house policy advisers objected to the breadth of mr. obama's keep your plan promise. they were overruled by political aides. your thoughts? >> it's unbelievable. look. the president didn't say if we like your health care plan you can keep your health care plan. he said if you like your health care plan, you can keep it. the fact is they were told -- this was a premeditated lie. before he said the words they were told that the words were not the true by the policy people, but the political people over ruled it. things like that don't just slip into speeches. there is a staffing process

where dozens of officials review every proposed presidential utterance. there is a fact-checking operation that goes through every word to make sure it is both accurate and defensible. as speech writers we would often come up with things we wanted the president to say. but if the fact checkers said, you can't say that, it's not true, out it wept. in their case the fact checkers said, you can't say that and they said it anyway. >> the journal reports a former official added to the journal in the midst of a hard fought political debate, quote, if you like your plan, you can probably keep it is not a salable point. that's obvious. but it's shocking to think that the president explicitly his led millions of americans about their health care. about health care. >> yep. >> and their relationship with their doctors, their children's relationships with their

doctors, knowing that it was untrue or having reason to understand that because it was more salable to say it the way he did. >> yep. on top of that, after he started saying it and they started being concerned that this wasn't true they went back and debated about wlrpt they should go out and have him do interviews to put nuance on the president's line. they decided not to because officials worried that delving into details about the number of people that could lose insurance could be confusing and clutter the president's message. the truth would clutter the message? they knew it was untrue, debated whether to come clean and the do the spin they are doing now a few years ago before the bill was passed. if they had done it then the bill wouldn't have been passed. >> that's the thing. as you have said this promise went to the core of the health care law. would this law have passed -- by the way, it had no republican

support and never had majority support of the american people. would it have passed if he went out and told the truth? we could have had a fair, honest debate about whether people wanted to sacrifice their relationships with their doctors and their families' relationships with their doctors so we could help a pool of uninsured or maybe was there a better way to help those people? >> that's right. they knew. they keep saying we have this grandfathering provision in there. we wanted to let people keep their plans. except they wrote the regulation so most of the people wouldn't qualify for grandfathering. they needed people to lose insurance because they need 2 million people who are healthy to move into the exchanges to subsidize the poor. >> the president doesn't see it that way. here is more of what he said tonight on the subject of misleading and misinformation about the health care law. listen. >> there is nothing new to have a bunch of folks spreading fear

and misinformation and confusion and cynicism about this law. we have been facing it for four years. we're used to that. >> you call him out on broken promises and that's the response marc. >> spreading misinformation. more than twoimes he said if you like your health care plan, you can keep your health care plan, no matter what. he's accusing critics of spreading misinformation? even his own supporters aren't buying the spin. the white house is isolated. the new york times. one of the chief supporters of obama care wrote an editorial this weekend, mr. obama clearly misspoke. they are not even buying the spin. but he didn't misspeak. he lied. >> the ombudsman of the times said, misspoke, really? they admitted that they could have said he just didn't tell the truth which also would have been an accurate statement. marc, thank you. >> thank you. >> the house oversight committee releasing more bombshell obama care documents revealing as the president encouraged people to

go over the phone or to use old-fashioned paper forms to search the exchanges and buy one of his new plans the administration knew the phone lines and applications would move no more quickly than the broken website because they had to go through the website. we see meeting note that is say the paper applications allow people the to feel like they are moving forward in the process and provides another option but at the end of the day we are all stuck in the same queue. watch what happens when the white house was pressed on that today. >> john, i get it. the person who calls isn't the one who continues to wait after the paper application is filed. >> your mocking is entertaining but the president said you get a reply within 25 minutes. that's not true. >> there is a reason to be quizzical here. you call up, give your information, get your questions answered. they take over from there and you find out what you are eligible for and the process

goes forward. >> joining me now, republican south carolina congressman trey goudy, a member of the committee uncovering the documents. they have subpoenaed kathleen sebelius for more. good to see you tonight. as the president was out there with the 800 number he knew that basically was just another way of sending people to the website ultimately. >> it's a facade. it's one of several facades, megyn. the president already has a nobel prize for peace. i think he's shooting for one in fiction to send people to the mail instead of the website when you know you are going in exactly the same queue is to create an appearance that everything is going swimmingly when you know otherwise. >> why can't there be honesty? we picked it up with marc. why can't he say, i didn't tell the truth or broke a promise.

essentially. the stage four cancer victim, to be specific. white house senior adviser dan fiefr tweeting how this is a chance for edie to get better insurance, but she doesn't want better insurance, dan. she liked the insurance she had which she says paid out $12 million to keep her alive and never questioned a claim. people keep posting stories about the challenges they are enduring. the 3.5 million. trace gallder has one tonight. trace? >> chris and sandra own a telecommunications country in new york. they have '01ed it 26 years and have eight full-time employees. they were considering hiring five more but it's on hold because their employees are union. so the company is required to pay their health insurance. the couple was notified by emblem health that their company cadillac plan, not a substandard plan, no longer qualifies. they were told to shop around. they did. here is the best they came up

with. currently they pay $355 per employee per month. the new premium, $733 per employee per month. that's a 106% increase. now they say something has got to give. listen. >> bonuses, raises for employees won't be what is expected. possibly raising our. rates to my clients to help pay -- to make up for the margins of profit we are losing. >> it's difficultle to be competitive in a small business environment when we have this struggle with the extra costs. we actually did not expect it. >> if they went ahead and hired the five new employees their health care costs would go from $2800 in december to $9400 come january. listen again. >> we provide jobs that our employees didn't have before.

we are offering a livelihood for people. i feel like the small businesses are just not being taken care of. >> they never bought into the rhetoric where they might save money under obama care but they never dreamed their premiums would more than double. megyn. >> trace, thank you. joining me now, matt bennett, former clinton white house assistant and from the think tank third way and chris plant of the chris plant show. matt, your thoughts? >> look, there are going to be a lot of these anecdotes. those are difficult for the white house. no question about it. on the other side of the equation there is a lot of anecdotes about 50 million people who didn't have health care coverage before the aca was passed. >> we knew that. let me stop you. there was never a question that the people who didn't have insurance were never going to get insurance on obama care. that's four years ago news.

what's news is people are losing coverage and plans contrary to the president's promise. your thoughts? >> that's right. if he said, instead of saying if you like your plan you can keep it, if you have a good plan you could keep it. that would have been better. we wouldn't have that discussion at this point. there is no doubt that was a mistake in the way the white house talked about this back when this bill was moving. i think they wished they could do it over again. it won't be fatal. >> that's the question. was it a mistake or an intentional lie? >> it's impossible to imagine they got this much wrong for this long. these aren't anecdotes. these are human stories. this thing is just a catastrophe. it's beyond my ability to understood. they knew the truth. somebody had to read the bill, if only the people who wrote it. they knew what was in it. >> the white house now. the journal shows without question that the white house

knew. the question is whether the president knew. but that leads to the question, matt, if the white house aides knew and political appointees and aides said keep the messaging. it doesn't sound good to put qualifiers in it and sebelius changed the regs after the law passed to cut out the grandfathering and they didn't tell the president doesn't he have to answer for that, too? >> yes. this is a difficult position he's put in. they are answering for it every day. jay carney is getting questions. >> you heard the president today. did he come close to ak knowledging what he put the american people through -- he and everyone who voted for this law bes based on a deception. >> i reject that premise and so would he. he would say, look, in retrospect i wish i had said it differently. i wish i had said if you have good health care coverage you can keep it. if you have lousy -- >> please. >> i don't understand how it is

not a deception when you've got proof that senior members of the administration knew that promise was not true. >> they knew if they told the truth that the bill never would have gotten the through. it wouldn't have had enough support on the hill to get through. it squeaked through in a party line vote on christmas eve as the it is. if they told the truth it wouldn't have been law. now they are inventing new lies to cover up old lies. it's almost pathological what he heard tonight from the president claiming he said this all along. i mean, that's really something new. i've got to say. >> matt, what about the president boldly saying what we said was -- you have to admit that's not at all -- he did not say that all along. >> it's what they were trying to communicate all along. >> how about what we were trying to say. he said if you like it, you can keep it, period, i guarantee it. i have to go. great to see you.

back to breaking news from the president's speech a short time ago today. the president now claims he did not promise americans could keep insurance plans if they like them. he said he's been telling us all along we could keep the plans as long as nothing changed about those plans. that's not true. millions are being cancelled at the this moment. now we have a new study out today estimating that 129 million people may not be able to keep the health care plans they have once obama care is fully implemented.

129 million. stu varney is with me now. 129 million will see some change and this estimate suggests that 18 to 50 million will literally lose their plans all together. >> the number keeps going up, doesn't it? remember, we started with 10 million, 93 million. now the grand total of 129 million people. that compounds the president's original deception. the source for the latest big number is christopher conover at duke. he studied what will happen when obama care is fully implemented. he came to the conclusion that 129 million people, two-thirds of the population will not be able to keep their plan. as you said, up to 50 million will lose their plan entirely. the rest will pay a lot more for what he calls obama care's bells and whistles. >> forbes magazine has a report

today suggesting that the individual market premiums will go up by 41%. in the individual market in the average state premiums likely to go up 41% and then this number 129 million, the way he get there is is he takes a look at not just the individual market. he looks at -- >> that's the employer sponsored market which has a lot more people in it. people who may feel secure right now. >> most of us get our health insurance through our employer. it's that large group of people who will be affected next year. the letters are the cancellation letters or raising the price of the coverage. they will go out right before the november elections of next year. that means this is a political bombshell that's unfolding as we speak. you've got the president deceiving the people. 129 million people probably affected. that's middle america really squeezed. that's a political bombshell before an election. >> the reason it's not taking

place until next year is the president postponed the employer mandate for a year. by himself he did that the. there was a question about whether it might be a political move. now that we see the individual market going away, it's basically been eliminated by the president and those who voted for this law. now when we look back at the president's decision to postpone the employer mandate, you have to ask yourself what they knew and what they saw coming and what is coming at all of us who have employer sponsored health care. >> it's a long period of oh deception. we have been deceived. the truth has not been told. had it been told, had the president been thoroughly honest way back when -- 2009, 2010, i suspect the outcome of the elections may have been different and obama care may not have been passed in the first place. >> all they want to do is point to the people who are being insured thanks to obama care. there are millions of americans who are gaining coverage when they didn't have it before this

insurance you can keep it. she voted against it after the law was passed. somebody introduced a bill like that and she voted against it. >> do they want to be held accountable? they will peel away. financial implications. young people aren't paying in. medicaid and subsidized people are taking a great deal of money out. these rising premiums will take an enormous amount of money out of the economy. that's a financial bombshell. >> forbes said the steepest hikes are on the healthy, young and men. >> yes. >> men face 77% increase for 27-year-olds, 37% for 40-year-olds and 47% increase for 64-year-olds. >> one more from the study. the networks narrow. that means it's difficult to keep the doctor you know and like. the hospital you know and like. you have a much smaller level of choice. >> we are already seeing that. the stage four cancer victim who

if you had one of these plans before the affordable care act came into law and you really liked that plan, what we said was you could keep it if it hasn't changed since the law has passed. >> that was president obama just a couple of hours ago. that's today. basically rewriting the fundamental pledge he made repeatedly to the american people as he was selling the obama care over haul which revamped one-sixth of the economy and affected thing of millions of americans. this has new polls from george washington university shows the broken promise may have an impact. this as 50% have an unfavorable opinion of him on a personal level. it's been key for him. he's always done well on oh this.

i don't think so. they should not have been there even by their own numbers the if they believe 95% of people would be able to keep their plans or get insurance for the first time and 5% of the population which is millions of people -- >> almost 15 million. >> but if they knew that -- and they did, they should never -- they should have said what he said tonight. they should have been saying it for the last two, three years. >> what we found was there was internal discussion in the white house. about this very issue. it's not like it went up detected. what he's saying is not right. the political people said keep your mouth shut. we don't want the qualifiers. >> i'm saying the aides did a disservice to the president and the country. we'll never know if he said what he said tonight whether the law

would have passed. but he's now got a credibility problem because it's clear that when you say "period," when you put a period at the end and say repeatedly you won't have the to change your plan, period, you will be able to keep your doctor, period, it means period, 100%. being 95% right doesn't make it -- you have to be 100% the truth. >> it doesn't suggest to anybody that a couple months after the law is passed they should pull out the federal register and flip through to page 34,550. >> a lot of pages. >> and find how sebelius is tightening the noose the on the grandfathering clause so they can find out period didn't mean period, it meant asterisk and read the a tab in the federal register. >> what they have to do now is get in front of this and get
